Concepts In Health Inc., the maker of MidNite Sleep Remedy, has settled a patent dispute with a store-brand manufacturer producing a private-label version of the product for a retail chain.

BLAUVELT, N.Y. — Concepts In Health Inc., the maker of MidNite Sleep Remedy, has settled a patent dispute with a store-brand manufacturer producing a private-label version of the product for a retail chain.

Under the settlement, contract manufacturer Contract Pharmacal has agreed to discontinue manufacturing and selling the store-brand sleep remedy or "any substantially similar product," according to Concepts In Health. Contract Pharmacal also won’t challenge the validity or enforceability of the MidNite patent, Concepts In Health said.

Financial and other terms of the settlement weren’t disclosed.

"We are deeply gratified by the outcome of this settlement," Holly Rosenthal, founder and president of Concepts In Health, said in a statement. "We believe it provides validation for America’s patent system and reinforces some of this country’s most deeply held values: innovation and entrepreneurship. We will continue to vigorously protect our intellectual property at whatever cost."

Concepts In Health manufactures and markets natural dietary supplements, including the MidNite Sleep Remedy natural sleep aid brand and NatuRelief natural pain reliever.
