PHILADELPHIA — On May 22, 2023, a Delaware jury dismissed each of Centene’s claims against Rite Aid in a case originally filed in 2019 relating to usual and customary pricing practices. As a result, Rite Aid faces no liability for any financial damages in the matter.
The suit, filed by a group of health insurance and pharmacy benefit companies under common ownership of Centene Corporation, alleged that Rite Aid misrepresented prices it charged for pharmaceuticals under applicable contracts. After deliberating for just three hours, the jury resolved the matter by rejecting all claims brought against Rite Aid and endorsing Rite Aid’s defenses. In a statement, the company called the verdict a “powerful validation of our position and our practices.”
